NULLIFICATION OF THE PURPORTED IMPEACHMENT OF PRINCE EZE MADUMERE: ONYEAGUCHA CALLS ON THE STATE HOUSE OF ASSEMBLY TO IMPEACH GOVERNOR ETHELBERT OKOROCHA WITH IMMEDIATE EFFECT

HON UCHE ONYEAGUCHA APPLAUDS IMO HIGH COURT FOR THE LANDMARK JUDGEMENT

Following the recent nullification of the purported impeachment of the Imo State Deputy Governor, Prince Eze Madumere today by an Imo State High Court, the frontline APGA governorship aspirant in the State, Hon Uche Onyeagucha has called on the House of Assembly to commence the impeachment of Governor Ethelbert Okorocha.

This has become imperative now considering the various mess the Governor has brought upon the State. He has continued to position himself as a grand despot and ruthless Emperor trying to turn the Imo into his personal chattel. His excesses have assumed an alarming proportion.

We are happy today that the court has nullified and declared as null and void Governor Okorocha's sponsored impeachment of his deputy, Prince Eze Madumere.

We are also convinced that very soon he shall face the consequences of all the atrocities, Impunity and dubious financial transactions he has committed against the people of Imo State.

We also commend the industry of the court by standing on the side of the truth and nullifying the sponsored impeachment of the State deputy Governor. This is indeed a victory for our democracy.
We equally felicitate with the Prince Eze Madumere for this resounding victory against Governor Ethelbert Okorocha's brigandage and tyranny.

We therefore, call on the people of the State to instruct their representatives in the State House of Assembly to impeach Governor Okorocha with immediate effect.
Finally, we kindly remind Governor Okorocha the legal maxim which says "be you never so high, the law is above you".

Appointment of new DG DSS: Buhari's vote-of-no-confidence in One Nigeria
The outright disregard for the conditions precedent for a united Nigeria and an inclusive country which President Buhari has become well known for was taken to a new height this evening with the removal of  the Acting DG of DSS,Mr Matthew Seiyefa and replacement with Mr Yusuf Magaji Bichi from Kano.

The I-don't-care and in-your-face attitude of the President in restoring Nigeria security architecture to the provocative situation of having 16 out of 17 Service Chiefs from his corner of the country is a clear demonstration of the fact that Nigeria for General Muhammadu Buhari is no more than his section of Nigeria and the resources and the constitutionally mandatory votes from other sections of the country.

Since 1960, Nigeria has never had a leader more sectional, narrow, parochial, and tribalistic like the current President who went on a global stage to divide Nigeria into "97 % and 5%".
We have  looked critically at the profiles of the Acting DG who was removed and the one Buhari just appointed and it is crystal clear that Bichi does not come with any experience close to that of Seiyefa.The only qualification for this appointment is therefore only the rabid nepotism of the President which has seen him always masking personal and sectional interest as "National Interest."
Besides, Bichi is an out-of-the -system man drafted by Mr Lawan Daura in the days of his nepotism rule at the DSS.The next six most senior persons in line of succession at the DSS after Seiyefa from our findings are all southerners, which may explain why the President picked a man who already retired from the DSS to lead because of ethnic affinity.

That the President went ahead to deep himself further into the cocoon of ethnic irredentism in making this insensitive appointment shows clearly that he does not care a hoot about the unity ,cohesion and oneness of Nigeria.

We reject this appointment and we do not shy in telling Mr President that he no longer pretends that the country is one under him.

In the last few days, there have been fears coming from the international community about the dangers that would come the way of  Nigeria if Mr President returns for another term. With his latest action, we add that the country is not safe in the remainder of his first term.
Lastly we ask Mr President : Are we still one county ?

The Ripples In That Presidential Acrobatics

There must always be lots of certainties that tempt you to believe your audiences are bored, particularly, when the number of reactions to your write-ups decline with time. In view of this fact , permit me here to begin this one with an apology, should I bore you always. I guess this boredom would not be because I bother you always with the errors committed by one particular character or in having you read about the blunders of this same character in every write-up l pencil down but perhaps in telling you always what you already know would be. I think I should be pardoned for this.  I am quite old and likely to tell the same story to the same listeners three times a day.

In life, there are three wants which can never be satisfied : that of an ignorant, who wants to sound educated ; that of the sick,  who wants to be seen healthy;  and that of a noise maker, who wants people to believe he is making common sense. Every clowns exhibit one or more of these wants and It would be impossible to guess the much, the clown's brain would be left desolate when all these wants manifest in him simultaneously. Any academic discourse geared towards analysing such misfortune would be full of hilarity.

Late last month, a  comic relief was displayed to make ripples in our nation's polity. It played out as an 800-meter-distance-walk story. This short distance was presumably made to erase doubts on the fitness of Mr President. It will be recalled that earlier that month the President went to London on a medical expedition where he spent more than the ten days he asked for. So there should be a distraction to remove our minds from the extra days. The  distraction in this fitness exercise was not Buhari's success claim in the exercise as a reason to run for the 2019 presidential election but the prop up of many undemocratic utterances that trailed his return . One of interest was a comment which threatened to jail more looters, another, which was made to give the first, authenticity: an unintelligent talk that submits that national interest was not subject to rule of law. These two statements by the president, which I see as mere bluffs, would put doubt on the minds of many who had earlier on described him as a reformed democrat when cognisance is taken to the many rights he abused during his reign as a military head of state . But does the leopard  change its spots?

Last week , one of his admirers put up some weak defenses that tend to favour an unpopular claim that the party sold to him the promotion of impunity at the expense of the rule of law to enable him succeed in the purported war against corruption he is said to be fighting . The big dumb questions here are : is the party ignorant of the theory of the fruit of the poisonous tree in law? Is the party also not aware that such defenses would rightly portray the platform on which he stands anti democratic and affirm the impunity the opposition claims is rife with his style of governance. Why would a president say that national interest should overrule the rule of law ? Rule of law which is the fundamental principle on which every constitution, including the one he took an oath to defend is based upon. In the absence of law, is it not a social misconduct to ask one to take the faults of his youth with him into old age when old age comes with its own defects. No reason would ever justify the impunity in this government.  You can tell us also that it was national interest to allow the appointment of Kemi Adeosun as minister for finance to stand when convincing evidences point to the illegality in the issuance of her NYSC discharge certificate . So the national interest in the choice of appointing her a minister of finance has now overruled what the law says about forgery, perjury and nonparticipation in the NYSC scheme. The President has just demonstrated by this that all the illegality identified in the appointments he has made so far could not be overruled by the rule of law governing such appointments as enshrined in the constitution he swore to protect because he saw them as national interest .  Presumably also,  it was national interest for the likes of Oji Uzoh kalu,  Akpabio,  Jim Nwobodo who have corruption cases pending in court to join the APC so that the national interest as determined by only the President would now overrule the constitutional penalty as enshrined in the law which he took an oath to protect. Nigerians are wise.  We have identified where your intentions were, long before you carried out your threat to jail more looters.  We understood you to mean you were bent on jailing more of the  opposition members.

Few other admirers too see cues to romance with excuses that paint him as copy cat who merely recites scripts written by some mischievous and controversial SANs in his government of which he has little or no input to make. This excuse gives enough impetus to complement Trump's comment that left him "dead man sitting on Nigeria's Presidential Seat".  While I  may not in its entirety support the publicity Trump accorded to his personal observation,  I would , however,  not fail to blame Buhari for this comment.  Someone says,  it is beneficial in this world to live after the world's opinions; it is equally beneficial in solitude to live after your own; but the great man is he who in the midst of the people of the world keeps, with perfect sweetness , the independence of solitude.

Buhari has not kept,  with perfect sweetness,  the independence of solitude.  He cheapened his exalted seat before Trump by his utterances and body languages. Perhaps the reason Trump called him lifeless. But how true is it that this Buhari is lifeless?  To answer this question, perhaps the best approach would be to refer to historical records with a view to analyzing his behavioral patterns vis a vis Trump's observations on a portal that would tend to compare him with his past. This would suffice to deduce his present activity status.

Many would recall that, with full cognisance to, and with respect for the military strength of Great Britain; their nuclear capability and perhaps, their back-up power : the US, this Trump's lifeless being , who already knew much about the reason Idi Amin called off his bluff and horridly freed a British journalist he condemned to death on a false charge of espionage when British naval warships set sail towards Uganda, still found courage  enough to infiltrated into Great Britain, through gaps in their security system, in a bid to freight Umaru Dikko , who was enjoying asylum in London back to Nigeria .violating Britain's territorial integrity. Although the success story of this feat was cut short by Dikko's secretary, a Nigerian, who informed the British authorities of the kidnap, the effort could not, in any ramification, be said to be lifeless. Peradventure, the same being who performed this feat then, now stands before Trump with a posture that replicates a frightened mouse , reciting written speeches in an uncoordinated manner,  then Trump would be right in his use of the term lifeless.

Our greatest problem in Nigeria today emanates from the fact that APC presented a president who is not in charge of activities and surrounded him with liars who don't have good enough memory to make successful liars. The factuality of this has been demonstrated by the party on several occasions with Buhari's utterances and body languages doing much in acquainting us that he stands ignorant of many activities of political interest going on in the country. This notwithstanding,  APC wants all to believe Buhari is the only worthy candidate . The party may have him as its best candidate.  Other parties have their best candidates too.  So the question of the right candidate; the only candidate;: the only Saint in a population of 180 million people does not exist but only brings to life the comment Cameron made about Nigeria as a fantastically corrupt country. His reasoning made sense since Buhari is said to be the only saint in a population of 180 million people. This is the kind of reasoning we face when people who are not educated enough to define democracy beyond, "government of the people by the people and for the people" are elected to lead in a democratic setup. They forget that the same man who gave that definition further stated,  and I quote.: "As I would not be a slave , so I would not be a master . This expresses my idea of democracy. Whatever differs from this,  to the extent of the difference, is no democracy." Why have they made themselves masters and us slaves by the lies they tell in governance ? There is nothing more terrible to see ignorance in action.  APC may call Buhari their best,  I have no problem with that.  But remember Abraham Lincoln once asked "how many legs does a dog have if you call the tail a leg ? Four,  he answered himself that calling a tail a leg does not make it a leg. To make this one man credible, the APC has narrowed down the definition of corruption to exclude every other aspect leaving out embezzlement of fund.

I have deliberately left out being emphatic on my conclusion on the status of Trump's comment. Whether fallacy or reality? This is because I felt it was Trump's personal view that should have been borne in his mind. But ask yourself this question: would it be a fallacy when it has been confirmed that cabals run this government for him. The wife of the President has raised this alarm on several occasions to attest to the fact.

IMO IMPEACHMENT SAGA: COUNSELS MAKE THEIR SUBMISSIONS, AS COURT ADJOURNS SINE DIE

REVELATIONS SHOWS PANEL REPORT NOT SIGNED,  CJ FAILED TO CONSTITUTE PANEL IN 7 DAYS

Yesterday, Imo State High Court witnessed legal fireworks between Imo State Deputy Governor’s legal team led by Chief Ken Njemanze (SAN) back by Professor Francis Dike (SAN) and Counsels to Imo State House of Assembly led by the Attorney-General of Imo State, Mr. Miletus Nlemadim.

In a motion filed on behalf of the Plaintiff, Prince Madumere, the Senior Advocate of Nigeria, had prayed the Presiding Judge, Hon. Justice Benjamin Iheka, to set aside the purported impeachment of the Deputy Governor, describing the alleged action as illegal since there was a subsisting  court order made in High Court 8 also presided over by Justice Iheka.

The Senior Advocate told the court that the alleged action of lawmakers was meant to ridicule Imo State High Court of competent jurisdiction. He therefore called of the presiding Judge to invoke the inherent powers of the court to address the violation so as to avoid subjecting the court to ridicule. Njemanze (SAN), revealed that there were constitutional breach in the constitution of the 7 man panel, arguing that the Chief Judge, Hon. Justice Paschal Nnadi allegedly failed to set the said panel within the specified 7 days prescribed by the Constitution, thereby rendering the panel null, void and of no effect.

“When the Constitution says that the CJ must act within the specified time, he must comply, otherwise his act thereafter will be null, void and of no effect. The prescribed time cannot be enlarged or extended without doing extensive harm to the Constitution and the aggrieved party.

“From the facts before this honourable Court, the CJ appointed the seven-man panel on July 20, 2018, and the Defendants clearly confirmed this date in their counter affidavits. The appointment was made nine days after the motion by the House of Assembly and the request of the Assembly Speaker.

We urge this honourable court to hold that having done so outside the stipulated time, the appointment of the seven-man panel by the CJ is null, void and of no effect.

“The alleged submission of the panel report is very doubtful and indeed, false. Who prepared the document? Who signed it? The court can’t be left to speculate on these issues. This purported report made by the panelists, is in the custody of the second to 10 defendants.

“They did not find it worthy to exhibit the document in court. The presumption on our side is that no such document exists and the court should so hold.”

Continuing, he queried the purported report of the panel, which he showed to the court, which had no signatory neither was the name of any of the members of the panel found on it, describing it as a mere piece of paper.

“The alleged submission of the panel report is very doubtful and indeed, false. Who prepared the document? Who signed it? The court can’t be left to speculate on these issues. This purported report made by the panelists, is in the custody of the second to 10 defendants.

“They did not find it worthy to exhibit the document in court. The presumption on our side is that no such document exists and the court should so hold.”

However, the lead Counsel to the Speaker and Imo State House of Assembly, Chief Onyechi Ikpeazu (SAN) described Njemanze’s call for the court to invoke its inherent powers to protect itself from ridicule against any members of the parties in the suit as a dangerous invitation tacitly to punish his clients.

In a swift argument, Attorney-General, argued that the court has no jurisdiction to determine the impeachment case filed by the plaintiff, thereby calling for its dismissal, which was vehemently opposed by Prince Madumere’s lead Counsel.

To the consternation of many, the Attorney-General of the State also raised the issue of non-service of the originating summon and other court processes on the defendants, especially that of the members of the panel. It will be recalled that that the Presiding Judge had granted an order allowing the plaintiff to serve the members of the said 7 man panel through the office of the Chief Judge since they were allegedly unknown to them.

The Counsels to the plaintiff and that of the defendants were able to make all their submissions and the court was adjourned to an undisclosed date. The presiding Judge, promised to contact Counsels to the parties in the matter through text messages.

Uche Nwosu launched his Own Private School - East High College Owerri, Pupils to pay N150,000 School Fees

In the last 7½ years, Imo State Governor Rochas Okorocha through his 'free education' mentra has reduced the quality of learning and educational standard to a very low point. Imo which use to rank first in WASCE/NECO before Okorocha’s assumption of office in 2011 is now in the 5th position, Abia and Anambra States leading.

Secondary and primary school buildings and other educational infrastructures across the 27 LGAs of the State are in sorry state. The money provided by the federal government through Universal Basic Education (UBE) and Tertiary Education Trust Fund (Tetfund) for building and equiping primary, secondary and tertiary education are unaccounted for in the last seven years, except few poorly done fabricated school buildings and renovations that dotted Owerri Municipal City and abandoned uncompleted/fabricated block works along highways across the 27 LGAs without roofs, doors, windows, desk and other learning materials.

This poor educational standard in Imo with unconducive learning environment, low quality teachers and non availability of science and mathematics teachers has forced Imo parents to seek education of their children elsewhere.

Unfortunately, the same Governor Rochas Okorocha, his Chief of Staff and Son in-law, Uche Nwosu has cashed onto Imo peoples misery to open their own Private Primary and secondary school in Imo called "East High College Owerri" charging as much as One hundred and fifty thousand naira (N150, 000.00) for acceptance fees and twenty five thousand naira (N25, 000.00 for entrance examination fee. This is outside regular tuition fees. What a tragedy of history!

The private school owned by Uche Nwosu and his wife, Uloma Rochas Okorocha Nwosu is built and equipped with State of the art facility!

The Okorocha’s anointed 2019 Imo All Progressive Congress, APC, governorship aspirant, Ugwumba Uche Nwosu and wife, Lolo Uloma Rochas Nwosu are owners of multi-billion investments in Owerri, Abuja and Lagos, they include Hotels, Shopping mall, Agro-farm, Radio and TV Stations, Petrol Gas Stations, Estate, etc.

This is similar to the release of above thirty five million naira (N35, 000 000.00) monthly for the office of the first lady of Imo State for the default primary school children HUNDRED NAIRA (N100) take home which was fantasized by the Okorocha’s at Inauguration, but unfortunately that exercise has been a condit pipe to defraud and siphon Imo people's federal allocation.

While the exercise stopped immediately after the inaugurated, the rescue mission government has been approving capital receipt for it's execution up till now. You will then ask for what? 

Similar grants are continually made available for amnesty program for restive youths of Ohaji Egbema and Oguta LGAs through the office of the first Lady, yet the youths of the Oil producing communities have remain impoverished and today used as cannon folder for the actualization of Okorocha’s 3rd term bid through the vaulting political ambition of his Son-in-law, Uche Nwosu.

One would be worried to ask, where comes the fund used to build the estimated six billion naira (N6, 000 000 000.00) Estate at Akachi road owned by the wife of Imo State Governor, Nkechi Rochas Okorocha.

Imo is truly bleeding and in an intensive care unit waiting for God's intervention. Who will rescue my dear state of Imo, the Eastern Heartland of Owerri?

ASO ROCK ORDERS REVERSAL OF NEW POSTINGS IN DSS

The Presidency has ordered the Acting Director General of the Department of State Security Services, Mr Mathew Seiyefa to reverse recent redeployment of top officials of the spy agency. A source who spoke with our correspondent on the condition of anonymity s said that Aso Rock was not impressed with the new postings and had ordered that the postings be reversed.

The source also said that President Muhammadu Buhari was already shopping for a replacement of Seiyefa. Seiyefa was appointed by Vice President Yemi Osinbajo while acting as president following the sudden sack of Mr Lawal Daura who was relieved of his job after ordering a siege on the National Assembly.

The source said that the Villa was not comfortable with the new posting and has therefore asked the affected officers return to their earlier postings. Seiyefa, who joined the service in June 1984, has less than a year remaining. He will retire next year when he would have put in 35 years in service.

He was the most-senior official at the secret police when the axe ultimately fell on Daura.

Although, the Presidency said that President Muhammadu Buhari supported the sack of his kinsman, Daura, there were reports which claimed the contrary. Seiyefa, who was excited by his appointment has swiftly moved to curtail the excesses of some of his men and ordered a nationwide redeployment of top officials of the service with the aim of repositioning the agency.

Some state directors were said to have been too close to state governors where they were serving.

Others were said to have been compromised by the governors of the state where they serving.

However, unknown to the Acting DG, the Presidency did not buy his ideas of repositioning the service.

Immediately he was appointed, Seiyefa gave hint that he would not toe the inglorious path of his predecessor at a maiden press briefing on Thursday.

He promised to review all pending cases of illegal detention of persons, as well as the need to appoint a spokesperson for the department after three years of blackout imposed by Daura.

He also vowed to significantly improve the agency’s image from its current infamy to an institution packed with professionals in law enforcement and protection of citizens against internal aggression.

Seiyefa was born on October 17, 1960. He hailed from Ekeremor, an oceanside community and local government area west of Yenagoa, the Bayelsa State capital.

He attended Local Government Education Authority Primary School, Ekeremor. His secondary education was at Government College, Ughelli, in the neighbouring Delta State.

He studied law at the University of Jos and graduated with honours in 1982. Afterwards, he attended the Nigerian Law School in Victoria Island.

Seiyefa joined the State Security Service in 1984 when it was still known as National Security Organisation, shortly after completing his national youth service at the School of Islamic and Legal Studies, Kano.

Last week, an associate of Daura reportedly said that the former head of of DSS took the decision to invade the National Assembly after consulting with relevant authorities.

The associate also said Daura took all actions in national interest through a collective responsibility, including involvement of principal officers of sister agencies, even though he promised not to disclose on whose authority he relied on to lay siege to the National Assembly.
